Hijinx Terms of Use

1. Description

Hijinx is an application for playing games with attendees in a Google Meet call. The Hijinx platform, including the Hijinx Chrome Extension and the web pages at gqueues.com/hijinx (collectively, the "Services"), are owned and operated by GQueues LLC ("GQueues").

2. Limited License

Your use of the Services constitutes a non-exclusive, non-transferable, revocable, limited license to access and use the Services pursuant to the Terms of Use listed herein. GQueues reserves the right to terminate this license at any time for any reason. You understand and agree that the limited license to use the Services is provided on an AS IS and AS AVAILABLE basis. GQueues disclaims all responsibility and liability for the availability, timeliness, security, or reliability of the Services. GQueues also reserves the right to modify, suspend, or discontinue the Services and any related applications with or without notice at any time and without any liability to you.

3. Acceptance of Terms

GQueues provides a limited license for you to use the Services subject to the following Terms of Use, which may be updated by GQueues from time to time without notice to you. By accessing and using the Services, you accept and agree to be bound by the terms and provisions of these Terms of Use. If you do not accept and abide by these Terms of Use, you may not use the Services. Nothing in these Terms of Use shall be deemed to confer any third party rights or benefits.

4. Proper Use

You agree that you are responsible for your own communications and for any consequences thereof. You agree that you will use the Services in compliance with all applicable local, state, national, and international laws, rules, and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Services to upload, transmit, or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as determined by GQueues in its sole discretion; (ii) upload, transmit, or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual, or fiduciary rights or obligations; (iii) prevent others from using the Services; or (iv) use the Services for any fraudulent or inappropriate purpose. Violation of any of the foregoing may result in immediate termination of your account and may subject you to state and federal penalties and other legal consequences. GQueues reserves the right, but shall have no obligation, to investigate your use of the Services to determine whether a violation of the these Terms of Use has occurred or to comply with any applicable law, regulation, legal process, or governmental request.

5. Intellectual Property Rights

GQueues Intellectual Property Rights. You acknowledge that GQueues owns all right, title, and interest in and to the Services and all content therein, including without limitation all intellectual property rights and associated applications, and that such rights are protected by United States and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Services or related applications or any content therein. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Services or related applications. GQueues' intellectual property rights specifically include, but are not limited to, all rights to (i) the Services developed and provided by GQueues; and (ii) all software associated with the Services and related applications.

6. Representations and Warranties

You represent and warrant that you have all necessary right, power and authority to enter into the agreement of the Terms of Use and to perform the acts required of you hereunder.

7. Privacy

As a condition to using the Services, you agree to the terms of the Hijinx Privacy Policy as it may be updated from time to time. GQueues understands that privacy is important to you. You do, however, acknowledge and agree that GQueues may monitor, edit, or disclose your personal information, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms of Use and the Hijinx Privacy Policy, which can be found at https://www.gqueues.com/hijinx/privacy.

8. Age Requirements

The Services are available for persons age 16 years or older. To the extent prohibited by applicable law, GQueues does not allow use of the Services by anyone younger than 16 years old. If you are 16 or older, but under the age of 18, you should review these terms and conditions with your parent or guardian to make sure that you and your parent or guardian understand and agree to these terms and conditions.

9. Indemnification

You agree to hold harmless and indemnify GQueues and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Services and related applications, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and/or attorneys' fees, of every kind and nature.

10. Jurisdiction and Venue

By your use of the Services, you agree to submit to the personal and exclusive jurisdiction of the courts located within Boulder County, Colorado, USA.
